Arizona Record Sealing Law to Benefit Offenders 2023

Starting Jan. 1, 2023, a record sealing law will be enacted in Arizona, allowing previous offenders to file a motion to seal their arrest, conviction, and sentencing records based on the crime committed and conditions of punishment. If granted, the record will be closed off to the public, with only law enforcement able to view it. The law aims to help offenders who want a fresh start, but the type and age of the crime will impact eligibility. Waiting periods before filing a motion range from 2 to 10 years, depending on the severity of the crime. Arizona also offers expungement and set aside processes for certain offenders. Expungements are for marijuana-related offenses and allow offenders to expunge specific crimes from their records. Set aside allows offenders to show they have completed all terms of their sentence and restores civil rights, such as the right to vote, sit on a jury, and bear arms. A Certificate of Second Chance was added to the set aside law in 2021, providing a second chance for housing, occupational license, and employment opportunities.
