How is Debt Divided in a Georgia Divorce? Debt is divided in much the same way that assets are divided when a couple gets divorced in Georgia. We divide marital assets and debts equitably, meaning fairly, which does not always mean equally. The Court cannot order a credit card company to take one spouse’s name off of a particular debt and add the other spouse’s name in it’s place. So, as an example, the Court might order one spouse to make the monthly credit card payments on a card that is in the other spouse’s name. If there are sufficient assets, the Court might order that the house be sold to pay off existing debts and any money left over be divided between the parties.
